The European Court of Human Rights has ruled that an English woman cannot have IVF treatment using frozen embryos from a past relationship.
Howard Johnston, the former partner of Natallie Evans, withdrew his consent for the embryos to be used after the relationship ended in 2002.
Ms Evans, who is from Wiltshire, has been left infertile by cancer treatment. She said she was distraught at the court's decision.
She was trying to overturn an earlier ruling that her right to a family life cannot take precedence over her former partner's withdrawal of consent.
Mr Johnston said he was relieved that common sense had prevailed and that he wanted to choose when he became a parent.
