A 17-year-old Dublin boy, who was found guilty of the false imprisonment of form tánaiste Joan Burton during a protest in Jobstown in Tallaght, two years ago, has begun proceedings to get the court's finding overturned.
The Children's Court found last month that the prosecution had proved its case against the boy - who was 15 at the time of the protest.
But the judge imposed a conditional discharge - meaning he will be spared a criminal conviction if he is of good behaviour for the next nine months.
The boy had denied falsely imprisoning tMs Burton and her adviser Karen O'Connell in two garda vehicles for three hours during the demonstration on 15 November 2014.
In the Children's Court today, the boy's solicitor told Judge Timothy Lucey that he was lodging notice of an application to state a case to the High Court, clarifying a point of law.
In his finding last month, Judge John King said what happened in Jobstown was an atrocious series of events and the boy was an active participant.
However, he said the boy did not act in isolation and was in the presence of many adults who should have known better and may have influenced him.
