Two on trial over Limerick double murder

Two cousins have gone on trial accused of a double murder in Limerick last year.

Patrick O'Brien, 31, from Glanntan, Golf Links Road and Thomas Stewart, 28, of The Cedars, Briarfield both in Castletroy, have  pleaded not guilty to the murder of Desmond Kelly and Breda Waters on 9 January, 2011 at O'Malley Park.

The court heard  the two were shot dead within a ten-minute period and Mr Kelly's sister was in the house babysitting his five-month-old daughter at the time.

The Central Criminal Court was told that the lock was broken on the front door and two men walked in, shot Mr Kelly, 24, in the head, before going upstairs to the front bedroom and shooting Ms Waters, 28, in the neck.

Mr Kelly's sister Teresa was in another upstairs bedroom minding his daughter and the court was told she will be giving significant evidence about what she heard.

Senior Counsel Brendan Grehan said it is the prosecution's case that Mr O' Brien and his cousin Mr Stewart were the gunmen.

He told the jury witness and CCTV evidence will show the men were driven to a house that morning where they collected a shotgun and were dropped off at the entrance to O’Malley Park where the barrel of the gun was seen sticking out of Mr O' Brien's coat.

A cartridge was also found in the car.

The prosecution said the men were wearing distinctive clothes and were captured on CCTV entering the house at 8.48am that morning and leaving ten minutes later.

The prosecution also said the men then went into Anthony Kelly's home nearby where they eft the gun used in the killing before changing their clothes and leaving.

The men deny the charges of murder.
