Garda acquitted in dangerous driving causing death trial in Co Meath

A 31-year-old garda has been acquitted of a charge of dangerous driving causing death following a trial at Trim Circuit Criminal Court.

Trevor Owens, with an address in Cootehill, Co Cavan, had been charged following an investigation by the Garda Ombudsman into the death of 21-year-old Gary Tully.

Mr Tully died in a collision between his motorbike and a garda car driven by Garda Owens.

The accident occurred in August 2008 near Kells, where Garda Owens was stationed.

After two weeks of evidence by the prosecution, Garda Owens' legal team sought a direction from the trial judge, Margaret Heneghan.

The judge ruled that there was a conflict of evidence between prosecution witnesses that could not be resolved by a jury and so she ordered them to return a verdict of not guilty.

Judge Heneghan also praised the family of the late Mr Tully, saying they had conducted themselves with dignity during the trial.
