The Health Service Executive has taken over a 17-bed residential care centre for older people in Co Waterford.
Alternative accommodation is now being sought for the ten residents at Martin's Hospital in Portlaw.
The Health Information and Quality Authority said: "The registered provider is not proceeding with its appeal against the decisions of the Acting Chief Inspector of Social Services".
HIQA added that the provider has "consented to the Health Service Executive taking charge of the Martin Hospital from 3.00pm on 3 May 2012".
The HIQA report will be published in the coming weeks.
Previous inspection reports by HIQA highlighted that the provider of Martin's Hospital in Portlaw failed to address a number of issues.
These included inadequate fire procedures and medication management.
