Man jailed for 12 years over Doherty killing

A 27-year-old man has been sentenced to 12 years in prison for shooting dead a father-of-two in Dublin two years ago.

Robert Egan said he accidentally killed Wayne Doherty after the 32-year-old tried to wrestle a sawn-off shotgun from him at Oakview Way on 4 July 2009.

Egan said he brought the shotgun to the place where Wayne Doherty lived to shoot a friend of his in the legs after a fight at a Christening party earlier that day.

Mr Justice Patrick McCarthy suspended three years of the 12-year sentence.

He said an IRA splinter group was an evil presence in the background of the case and when Egan leaves prison, who knows the evil people in the background may seek to confront him again.

The court heard the victim was close to the IRA and that Egan's family home was targeted.

His brother Jason, a shopkeeper never involved in criminality, was shot dead in retaliation by the IRA.

The court also heard that a witness who gave evidence was told to do so by the IRA and that Wayne Doherty was given a paramilitary funeral.

The judge also said there was no doubt the Doherty family were still suffering and that Mr Doherty had acted lawfully when he told Egan to put the gun away and then tried to take it off him.
