An application by businessman and racehorse owner JP McManus for injunctions to force Facebook to shut down accounts claiming to be him has been struck out at the High Court, after the court heard the profiles have now been taken down.
Lawyers for Facebook told the court the profiles had been taken down and gave an undertaking that they would not go back up pending the result of the proceedings being taken by Mr McManus.
Last Friday Mr McManus looked for permission to notify Facebook of his intention to seek injunctions stopping the company from maintaining, facilitating or publishing the accounts and to take steps to close down or remove the accounts identified.
He is also seeking declarations that Facebook's failure to remove the accounts identified was an unlawful breach of his constitutional rights, as well as a declaration that the continued processing of personal data by maintaining the sites was a breach of the Data Protection Acts.
He is also seeking damages for defamation, malicious falsehood, fraudulent misrepresentation, negligence and breaches of his constitutional rights.
The case will be mentioned before the court again on Thursday.
