The High Court has awarded over €100,000 in damages to a Co Galway grandmother and her family following the death of her daughter and granddaughter in a road crash in Athenry five years ago.

Her daughter's partner, John Maloney, was also killed in the crash.

Mary Mahoney had sued Galway County Council and the estate of the late John Maloney, who was driving the car.

The insurance company of the deceased driver has accepted full liability.

In a brief statement, Mary Mahoney said that no amount of money could compensate for the loss of her beloved daughter, Yvonne, who was 24, and her two-year-old granddaughter Bobbi-Ann.

She said they would be sorely missed along with partner and father, John Maloney.

The 33-year-old man was the driver of the car which collided with another vehicle when he emerged from a minor onto a major road at Lodge Cross, Athenry, in July 2006.

Mary Mahoney sued both Galway County Council and the estate of the late John Maloney for mental distress.

In her statement of claim, it was alleged that the council had failed to provide a clear view of the crossroads and that there were no proper road signs at the junction. It was also alleged that John Maloney had been negligent in the manner of his driving.

In his judgement, Mr Justice Michael Moriarty said that following a complex set of proceedings and a lengthy and torturous hearing, the only matter to be decided by the court was the assessment of damages.

He awarded over €100,000 to Mary Mahoney and her family.

Counsel for the estate of the late John Maloney, Henry Burke, said that his clients - the insurance company of the deceased - had accepted liability in this case, thereby indemnifying Galway County Council.
