Businessman Denis O'Brien has been given permission to bring another legal challenge to the Moriarty Tribunal.
Mr O'Brien is challenging the tribunal's decision to restrict the examination of Danish telecommunications consultant Professor Michael Andersen.
Mr Justice Michael Moriarty ruled last Tuesday that Mr Andersen could not be questioned about allegations of bias he made about the tribunal's legal team and imposed strict time limits on lawyers examining the consultant.
Professor Andersen had told the tribunal he had to finish his evidence by last Friday and would not be available again until the second half of next year.
Mr O’Brien’s lawyers told the High Court that the effect of Justice Moriarty's ruling was to violate his natural and constitutional right to cross examine Mr Andersen.
According to the lawyers, Mr O’Brien wants Justice Moriarty's decision quashed as well as an injunction preventing the tribunal from finalising or publishing part two of its final report.
