The High Court has been told that one million tonnes of waste have been lodged at a landfill site near Naas in Co Kildare.
The amount of waste is in breach of the site's waste licence and the court heard that the situation is now 'critical'.
The statement was made by Nuala Butler, Senior Counsel for the Environmental Protection Agency.
The EPA went to the High Court seeking an interim injunction against Neiphin Trading Ltd, a company associated with A1 Waste, which operates a landfill at Kerdiffstown.
Ms Butler said her clients had received more than 200 complaints in just three months due to extreme odours, which were causing residents to vomit in their homes.
During the brief hearing, Ms Butler said that Naas Golf Club has also lost business as a result of the landfill activity at the Kerdiffstown site.
Shane Murphy, Senior Counsel for Neiphin Trading, sought an adjournment of the case to enable the exchange of legal papers.
He told the court that his client had been in contact with the EPA on securing additional odour treatment measures, but Ms Butler said they were wholly inadequate.
The case was heard before Mr Justice Sean Ryan who ordered an adjournment of proceedings till next Monday, but he added the case would go ahead then 'come what may'.
