The Court of Criminal Appeal has dismissed an appeal by Brian Kearney against his conviction for the murder of his wife Siobhan.

Mr Kearney, who is now 52, was found guilty at the Central Criminal Court in March 2008 of murdering his wife at their home at Carnroe, Knocknashee, Goatstown on 28 February 2006.

The three judge court today dismissed an appeal which claimed his conviction was 'manifestly unsafe'.

After a full day of hearing, the judges of the Court of Criminal Appeal took a 30-minute break before returning to dismiss Brian Kearney's appeal.

Presiding Judge Nicholas Kearns told the court a full written judgment outlining their reasons would follow 'in due course', but the Court was eager to give its decision as the courts close this week for their summer break.

The decision was met with an emotional response from Siobhan Kearney's family - her sisters hugged each other, others cheered loudly.

Brian Kearney was in court with members of his family.

He said the State had relied on 'subjective evidence and inferences', and argued it was a critical failure that the prosecution excluded the possibility of another person killing her.

However, the three main grounds of appeal were dismissed by the appeal court, which upheld the majority jury verdict of 11 to 1 which found Brian Kearney strangled his wife Siobhan with a vacuum cleaner flex at their south Dublin home in February 2008.

Showing little emotion, Brian Kearney was led away to resume his life sentence.
