Judge considers verdict in McCartney trial

The judge in the trial for the murder of Robert McCartney has retired to consider his verdict.

The 33-year-old father-of-two was beaten and stabbed outside a Belfast bar in January 2005.

Terence Malachy Davison, 51, is charged with his murder.

He and two co-accused, 39-year-old James McCormick and 47-year-old Joseph Fitzpatrick, are also charged with affray.

All three deny the charges against them.

Today in Belfast Crown court, lawyers for the three defendants criticised the prosecution case as being weak.

They also questioned the credibility of two of the prosecution witnesses.

The prosecution in turn pointed to the fact that none of the accused had given evidence on their own behalf, encouraging Mr Justice Gillen to draw an 'adverse inference' from this.

Following closing statements from both sides in Belfast Crown Court, presiding Judge Mr Justice Gillen thanked all sides and said that it was his indication to give his final verdict  ‘reasonably soon’.

He said he would endeavour to do this despite it being such a lengthy trial involving a substantial amount of documentation.
