McCartney judge refuses to stop case

The judge at the trial of three men accused of involvement in the murder of Robert McCartney has refused defence applications to stop the case.

The 33-year old died from a stab wound to his stomach following an attack in January 2005.

Mr Justice Gillen said the evidence against Terry Davison, who is charged with murdering Mr McCartney and Joseph Fitzpatrick and James McCormick, who are accused of causing an affray, was not so weak or discredited that it could not conceivably support a guilty verdict.

With the prosecution case concluded, lawyers for all defendants confirmed the three would not be giving evidence on their own behalf.
