The prosecution in the case of a 41-year-old Waterford man accused of murdering his wife has concluded its evidence.
John O'Brien denies murdering Meg Walsh between 1 October and 15 October 2006.
The jury has been told to return on Tuesday. Mr Justice Barry White told the jurors that at the conclusion of the prosecution case, the defence is entitled to apply to withdraw the case from them.
He said it was proposed to make such an application to him and it would be debated in court tomorrow. He said this would involve a review of the evidence.
He told the jury that if he acceded to this application that would be the end of the trial and they would return a verdict as directed by him.
However, he said if he did not accede to the application the trial would continue.
He said the defence had not yet revealed if it intended to call evidence in the case. The trial began on 14 April.
