The jury in the trial of a 41-year-old Waterford man for the murder of his wife has been told she claimed he assaulted her shortly before she disappeared.
John O'Brien denies murdering Meg Walsh between 1 and 15 October 2006.
The Central Criminal Court heard Ms Walsh told a solicitor and a Garda Sergeant that Mr O'Brien assaulted her on September 10 2006.
Sergeant Eric Gavigin said Ms Walsh did not want to proceed with complaint against her husband.
Garda Gerry Whelan gave evidence of going to meet John O'Brien on 2 October 2nd 2006 after Meg Walsh had been reported missing by work colleagues.
He said Mr O'Brien seemed very anxious and nervous.
But Mr Whelan said there was nothing out of the ordinary in the house and there was no evidence of violence.
Mr Whelan took a witness statement from Mr O'Brien later that evening.
In it, Mr O'Brien said he found his wife and another man Owen Walsh with their arms around each other kissing after the three of them had come home from a local pub.
Mr O'Brien said he asked his wife why she kissed Owen Walsh. He said she told him he drove her to it and he did not pay her enough attention.
Mr O'Brien said he last saw his wife at 5pm on the evening of 1 October and heard her go out at 8.30 that evening.
