Brian Kearney, who was convicted of murdering his wife Siobhan, has lodged an appeal against his conviction.

Siobhan Kearney was murdered at her home in Goatstown in Dublin on 28 February 2006.

On 5 March this year Brian Kearney was convicted of strangling his wife with a flex from a vacuum and then trying to make it look like suicide. Notice of intention to appeal was lodged last week and no details of the grounds of appeal have yet been revealed.

It is likely that Mr Kearney's lawyers will argue the case should have been withdrawn from the jury as it was based on circumstantial evidence and was not strong enough to allow them to come to a safe verdict.

An application by Patrick Gageby SC to direct the jury to find Mr Kearney not guilty on this basis, was rejected by Mr Justice Barry White during the trial.

There is currently a six to eight month waiting period for appeals to be heard in the Court of Criminal Appeal so it is unlikely to be heard before October.
