A 47-year-old man has been sentenced to three years in prison for dangerous driving causing the death of his brother near Kilgarvan, Co Kerry on 17 December 2006.
Thomas McDonagh, with addresses in Ballyduff, Co Kerry, and in Liverpool, pleaded guilty to the charge at the circuit court in Tralee today.
His 31-year-old brother, Martin, was a passenger in the car and was pronounced dead at the scene of the accident.
The court was told that the McDonaghs' car was being pursued by a garda patrol car when the crash occurred.
Thomas McDonagh also pleaded guilty to driving with excess alcohol and not having a license or insurance. He was disqualified for 20 years.
His Senior Counsel, Brendan Nix, said the accused had genuine remorse and was deeply sorry for the tragedy he had brought on the family.
