The deportation of Nigerian student Olukunle Elukanlo has been halted pending a High Court challenge on behalf of his four-month-old son.
Ms Justice Elizabeth Dunne turned down an application by 21-year-old Mr Elukanlo for his own judicial review of the decision to deport him.
But she granted the application on behalf of his baby son who it is argued is constitutionally entitled to a relationship with his father.
