A Dublin creche owner has been fined a total of €1,200 for breaches of the regulations governing pre-schools after a three-year-old child was left behind on an outing to a local park.
Anne Davy, the owner of Giggles Creche and Montessori School at Tolka Road in Dublin, had denied leaving the child unattended.
However, at Dublin District Court today Judge William Hamill said her evidence was not credible and conflicted with undisputed facts in the case.
Judge Hamill gave her two €600 fines on two charges of failing to ensure the health, safety and welfare of the child by leaving it unattended and for failing to ensure that children were properly insured.
He said the evidence of another witness who was unconnected with the child was totally credible.
Ms Davy was also convicted of failing to keep proper attendance records and staff rosters, for which no penalties were attached.
Costs of €1,000 were also awarded against her.
Counsel for Ms Davy said the creche had been regularly inspected and was never before found to be in breach of the regulations.
The counsel added that it was a purpose built creche and many parents continued to use it.
