The Director of Public Prosecutions is seeking a retrial of former Fine Gael town councillor Fred Forsey Jr on corruption charges.
The Director is seeking the retrial on public interest grounds. Mr Forsey is opposing the application.
Last month the Supreme Court quashed his conviction. It will give its decision on a retrial on 21 December.
Mr Forsey has already served his sentence.
He was jailed in 2012 for four years for receiving payments totalling €80,000 from a developer in 2006 when he was a member of Dungarvan Town Council.
Senior Counsel, Noel Whelan for the DPP said it was a serious offence and a retrial was in the public interest, including in retaining confidence in the administration of justice, public officials, local government and the planning process.
Mr Whelan said the fact Mr Forsey had served his sentence did not mean there should be no retrial.
He said prosecutions were not just brought for the purpose of imprisonment - they were also brought to hold a person to account for the offending.
Lawyers for Mr Forsey said he had already served the longest-ever sentence imposed for corruption and had endured the consequences of that.
