The family of John Carthy, who was shot dead by gardaí in Abbeylara nine years ago, has settled a legal action for damages against the Garda Commissioner and the State.

Mr Carthy's mother Rose and his sister Marie had taken the action after a retired High Court judge who investigated the incident concluded the 27-year-old should never have died.

The terms of the settlement have not been disclosed but it is understood the Carthy family are to receive a payment in the region of €100,000.

The Longford man was shot dead by the Garda Emergency Response Unit on 20 April 2000.

Mr Carthy was a manic depressive who had fired a shotgun on 30 occasions while the gardaí were outside his home.

The shooting was investigated by a retired High Court judge who later criticised the garda officers in charge of the operation.

The Barr Tribunal, which investigated the shooting, concluded in July 2006 at a cost of over €20m.
