Ruling in favour of Ireland over Sellafield

The UN Tribunal in The Hague hearing Ireland's case against Sellafield has given an order regarding provisional measures to preserve Ireland's rights in relation to the Irish Sea.

The order was given pending a final decision in a case that will conclude in a number of months.

The case is based on the 1982 UN Convention on the Law of the Sea.

The Tribunal agreed with Ireland's submission that the co-operation given by the UK under an earlier order issued in 2001 was not sufficiently ‘timely or effective’.

Britain must now agree a mechanism for co-operation with Ireland on issues of nuclear safety, and both parties must report on progress made in implementing the original 2001 order and the new decision.

The first of these progress reports must be submitted to the Tribunal by 12 September.
