Dublin Corporation withdraws action against sex shop

The Ann Summers Sex Shop is to continue operating in Dublin's O'Connell Street following the withdrawal of legal action by Dublin Corporation. Costs are to be paid by the Corporation. Rebecca Cox of Ann Summers Retail Ireland said they were delighted by the decision and looked forward to continued trading on O'Connell Street for many years. She said the decision could lead to the opening of further Ann Summers outlets around the country.
Dublin Corporation had attempted to stop Ann Summers Ireland Ltd. using a premises on O'Connell Street. The local authority had said it formed the view that the existence of such a shop at Lower O'Connell Street was contrary to proper planning and development of the area. The company started trading there on October 1st last, selling ladies underwear, hosiery, PVC wear as well as fun novelties amongst other items. When it served notice on the company, the Corporation believed the continued use of the premises as a sex shop was inappropriate and unsuitable to the main street of Dublin.
Last November, Ann Summers began their challenge to the Corporation's attempt to stop them using their shop in O'Connell Street. Today in the High Court, Eamon Galligan, counsel for the shop, said that a Section 37 notice under the Local Government Regulations, which had been the subject of the proceedings, was being withdrawn. Mr Justice Kelly struck out the action and awarded costs to Ann Summers Ltd.
