Labour councillor Angela Feeney is seeking permission from the High Court to be allowed a full recount of the Seanad agricultural panel result.
Ms Feeney lost a fortnight ago to Fine Gael's Maria Byrne by 0.116% of a vote in the convoluted Seanad vocational panel system.
While Ms Feeney was given a recount of the final count in that result, she did not receive a full recount of the entire agricultural panel election.
However, under section 54 of the Seanad Electoral Act 1947, an unsuccessful candidate may still seek a full recount if they are given permission to do so by the High Court.
Ms Feeney had 14 days - up to this weekend - to seek permission to bring a petition to the High Court for this purpose, which the court has today allowed.
Her petition will be examined at an unscheduled future date.
Any petition decision must involve the views of all other candidates and the views of the returning officer.
However, the move by Ms Feeney will not stop the Seanad from sitting at this stage and will only result in a change if her petition successfully overturns the agricultural panel election result.
