The jury in the trial of a 45-year-old man accused of murdering his stepson has been sent home for the evening and will resume its deliberations in the morning.

David Mahon denies murdering 23-year-old Dean Fitzpatrick at an apartment complex in Dublin three years ago.

The jury has spent just over five hours deliberating so far.

Mr Mahon claimed his stepson walked into a knife he was holding and his death was an accident.

The prosecution claimed Mr Mahon was drunk, angry and agitated and stabbed his stepson with deadly intent.

The jury of six men and six women deliberated for two hours and 21 minutes yesterday afternoon before being sent home for the night.

Before they resumed their deliberations at the Central Criminal Court this morning, the jurors asked a number of questions.

They asked for the knife block from the apartment Mr Mahon lived in at Burnell Square, Northern Cross, off the Malahide Road, as well as another knife from the balcony of that apartment.

They were told they could not have a copy of the pathologist's report but Ms Justice Margaret Heneghan said she could re-read the evidence of Deputy State Pathologist Dr Michael Curtis.

They also asked for the legal definition of all three possible verdicts open to them: guilty of murder, not guilty of murder but guilty of manslaughter and not guilty.
