US man on trial for alleged rape of Irish student

A 38-year-old man has gone on trial in New York for the alleged rape and assault of an Irish J1 student in the Hamptons in August 2013.

In its opening statement the prosecution told the court that Jason Lee had no regard for an Irish girl visiting the area and was going to do whatever he could to get sex. 

Mr Lee has waived his right to a jury trial and so the case is proceeding before Judge Barbara Kahn.

"What you see is not always what you get with Jason Lee", said prosecution lawyer Kerri Ann Kelly.

She said that Mr Lee may look like a well-dressed man but in the early hours of 20 August 2013 he wanted only one thing and that was sex.

The court heard that the Irish woman, then aged 20, had travelled to the wealthy beach area of New York to visit her brother who was working there

She was at the end of her J1 visa summer in another part of the US. 

On the night in question, the girl and her friend, and her brother and his friend went for what was described as "a night out in the Hamptons". 

They ended up in a nightclub where they met Mr Lee and his friend Rene Duncan, both married, who had travelled for the weekend from Manhattan to celebrate Mr Lee's 37th birthday.

The group partied together at a nightclub, posing for photographs and generally having fun, the court heard.

When it closed at around 4am, Mr Lee invited the Irish students to go back to his luxury summer rental home, he asked one of the other Irish students to take the car and drive the two local men home.

The prosecution lawyer told the court that when the group arrived at the house both girls took off their dresses and jumped into the swimming pool in their underwear but when Mr Lee jumped into the pool, he was completely naked.

She said the young women felt uncomfortable with this and so got out putting on borrowed shorts and t-shirts. Then the party continued in the kitchen with more champagne and pizza.

The young woman then wanted to change back into her dress to go home and went to a bathroom just down the hallway from the group.

Allegedly Mr Lee followed her, and pushed against the bathroom door. She pushed against it so hard that her fingerprints were clearly on the door. 

But he pushed harder the court heard, so hard that the door hit her, and knocked her onto the floor. She alleges that he then proceeded to rape her.

She alleges that she screamed out for her friend but he told her to shut up and put his hand over her mouth to quieten her.

His defence lawyer Andrew Landler told the court that he disputes this version of events, saying that if they both were screaming, the group would have heard them as they were only yards away from them.

The young woman says the attack only ended when she managed to knee him in the groin and he backed off.

She then returned to the group, and the prosecuting lawyer told the court that the trial will hear that she was hysterical.

By this stage, Mr Lee's friend Mr Duncan was becoming concerned about the whereabouts of his car and called the police.

The court heard that when the police came, Mr Lee met them at the end of the driveway and told them that "everything was good" and that they should leave.

But the young woman's brother urged them to talk to his sister so she got into the police car and explained what had happened.

The prosecution described how when the police officer looked up Mr Lee was gone.  He was not seen again for almost two hours, and was eventually found curled in the foetal position hiding in the back seat of a car.

The court heard that during this time he had made repeated efforts to call taxis to the house.  But his lawyer said there were good reasons for his behaviour that would become clear as the trial progressed.

Mr Lee is pleading not guilty and says the sex was consensual.

Mr Landler told the court that they felt there had been a rush to prosecute by the authorities and this was just a case of regrettable consensual sex. 

He said there were inconsistencies in the young woman’s version of events and in what witnesses would testify to.

The court heard that the young woman had been medically examined shortly after the alleged incident and had injuries that were consistent with the attack she had described.
