The Pakistan Supreme Court has summoned Prime Minister Yousuf Raza Gilani to appear on 13 February to be indicted over his refusal to pursue corruption cases against the president.

The move, only the second time the court has brought contempt charges against a sitting prime minister, plunges the weak government deeper into a crisis that could force early elections within months.

Judge Nasir Ul-Mulk told the court there were grounds to proceed against Mr Gilani over the government's refusal to follow a court order and ask Swiss authorities to re-open corruption cases against President Asif Ali Zardari.

The government argued that Mr Zardari has immunity from prosecution while head of state and accused judges of plotting with the military to wage a witch-hunt against him.

"We are satisfied that prima facie there is a case for further proceeding into the matter. Adjourned for 13 February, for framing charges. Prime minister is required to remain present in the court," Mr Mulk said in English.

Mr Gilani had appeared in court on 19 January, refusing to back down on Mr Zardari's immunity, although analysts say he risks being jailed for up to six months and disqualified from public office.

Mr Gilani's lawyer Aitzaz Ahsan said it was possible to appeal.

"There is a possibility for an appeal in this matter. It is up to the court whether to suspend this order or not. This will be decided after getting a copy of the order," he said.
