A man whose wife died of breast cancer after being given the all clear, has been awarded €110,000 in a settlement at the High Court.

Karl Henry of Westfield, Limerick Road in Ennis took the action against the Health Service Executive after his wife Anne Moriarty died in 2008.

Mr Henry said his wife's life was wrongfully cut short because of the delay in diagnosing that her cancer had come back.

If her condition had been diagnosed at the Mid Western General Hospital in Ennis, in June 2007 as it should have been, he claimed , she could have had chemotherapy.

She would have survived longer with fewer symptoms he claimed.
Ms Moriarty was diagnosed with breast cancer in 2005.

After her treatment she was considered to be in remission.

She was admitted to hospital in Ennis in June 2007 and an x ray was carried out but she was sent home with antibiotics.

Another x ray was carried out at the hospital in August that year but again she was discharged without any significant concerns being raised.

A few days later tests and scans at a clinic in Galway showed her cancer had come back and had spread. She died in April the following year.

Mr Justice John Quirke approved a settlement of €110,000 for Mr Henry today. He said it was a very sad case.
