Wexford - Accused staying in a mobile home

A Dublin man has gone on trial for the murder of Anthony Cullen in a Wexford caravan park two years ago.

Stephen Delaney of Belcare Grove in Ballymun admits the unlawful killing of the 37-year-old on 8 April 2007 but denies a charge of murder.

Opening the trial for the prosecution, Paul O'Higgins SC told the jury it would have to decide if Mr Delaney was guilty of murder or manslaughter.

He said to do so they would have to get inside his mind in so far as they could and decide if his state of mind was such that he had full intent to kill or seriously injure.

The background to the case was somewhat squalid and debauched involving a lot of drinking, he added.

Mr Cullen had been drinking for most of the day in Wexford when he was invited to Burmah Caravan Park, Rosslare.

The accused was staying in a mobile home there and throughout the night the victim got into a number of small fights and was falling around while extremely drunk.

He was thrown out of the caravan after soiling himself and remained outside in a drunken state for some time.

As he was leaving the caravan park, the prosecution says Mr Delaney armed himself with a knife and pursued him, stabbing him three times in the back.

The trial before Mr Justice George Birmingham and a jury of seven men and five women is expected to last two weeks.
