The jury in the trial of a 25-year-old Donegal man charged with dangerous driving causing the deaths of three people has failed to reach a verdict.
After deliberating for almost four and a half hours the jury in the case of Niall McGrath of Grahamstown, Ballintra, Co Donegal told Judge Raymond Fullam that they could not agree a verdict.
Mr McGrath denies dangerous driving causing the deaths of Damien and Teresa Quigg from Dungiven, both aged 49, and Nora McGee, 79, from Gortahork.
The prosecution alleged that Mr McGrath was driving his motorbike dangerously on the evening of the fatal crash at Ballintra, Co Donegal, in September 2005.
It was claimed that his driving caused a number of collisions, the first one was when his bike hit an on-coming car.
This triggered other collisions culminating in the crash between the Quiggs' car and the car in which Mrs McGee was travelling.
Mr McGrath denied the charges. he says that he was three feet from the white line on his side of the road when the initial collision with an on-coming car happened.
He said the car came out of nowhere and all he remembers was the initial collision and then lying on the road.
Judge Fullam remanded Mr McGrath on continuing bail to the December sittings of the court.
