A Wexford court has ordered the Health Service Executive to disclose documents relating to their investigations into the death of Evelyn Joel more than two years ago.

The 58-year-old woman died six days after being admitted to Wexford General Hospital suffering from alleged malnourishment.

Mrs Joel lived in a house in Enniscorthy with her 32-year-old daughter, Eleanor, and Eleanor's 34-year-old partner, Jonathon Costen.

Both have pleaded not guilty to charges of manslaughter and reckless endangerment in relation to the death of Mrs Joel.

Following Mrs Joel's death, the HSE set up an independent inquiry and gave the committee up to 36 documents.

Judge Michael White requested that the HSE furnish all parties involved in the forthcoming criminal trial with those documents, but Wexford Circuit Court heard the HSE was refusing to do so.

Today, Judge White told the court that the most important matter is that the two accused get a fair trial, saying the HSE documents could be of assistance to them.

He ordered that all HSE material relating to the matter be handed over to the Director of Public Prosecutions, who will give them to the prosecution and defence teams.

He said matters of privilege and confidentiality would be dealt with on 10 June when the case is back up for mention.

In a statement this evening, the HSE says it would consider the matter further on receipt of transcripts of evidence from the court and legal advice.

The trial is expected to start in July at the earliest.
