The High Court has referred missing solicitor Michael Lynn's non-attendance in court to the DPP to decide whether criminal charges should be brought.
Senior Counsel Shane Murphy told the court that non-attendance on foot of a court order could be deemed to be a criminal matter and asked Mr Justice Richard Johnson to refer the matter to the DPP to decide whether criminal charges should be brought.
If criminal charges are brought against Mr Lynn it would enable the State to seek his extradition, if he is found outside the jurisdiction.
Gardaí have filed documents to the court setting out the inquiries they have made and the on-going investigation into Mr Lynn's whereabouts.
The court ruled that because the investigation is continuing the documents should not be made public at this time.
