Derek O'Toole's mother has said she is considering contacting the Garda Ombudsman to raise the issue of how gardaí dealt with her son's case.
The 24-year-old Clondalkin man was fatally injured when he was struck by a car being driven by an off-duty garda in Lucan last March.
Garda Damien Carey, who was driving the car, was found to be 4mg under the legal limit when breathalysed.
Christine O'Toole said she wants to know why Mr Carey was not tested at the scene and was instead driven to a garda station 14km away.
