A US military judge has filed terrorism charges against an Australian man who has been held without trial at Guantanamo Bay for five years.

David Hicks, 31, was detained in Afghanistan where he allegedly fought alongside the ruling Taliban against US-led forces.

Mr Hicks will be the first Guantanamo Bay detainee to be charged under a new US law authorising special military trials of 'enemy combatants'.

His lawyer Michael Mori insists that the charge, 'material support for terrorism', has been made up.
