Curtin considers appeal over court ruling

The Circuit Court Judge, Brian Curtin, has yet to decide if he will appeal a High Court decision which dismissed his challenge to an Oireachtas committee investigating his alleged misbehaviour.

However today he was partially successful in recovering some of the costs of the legal proceedings.

If there is no appeal, Judge Curtin will not have to pay the judicial review costs of the State legal team or the legal costs of the Select Committee. 

However he will have to bear his own costs.  He was also given his legal costs of an earlier application to the court last year seeking leave to bring the challenge.

However the costs awarded to Judge Curtin are subject to a stay on the Judge's order in the event of an appeal by either side to the Supreme Court.
