The Court of Criminal Appeal has quashed the manslaughter conviction of the only man convicted of the killing of Brian Murphy outside Club Anabel in August 2000.

Dermot Laide, 23, from Castleblayney, Co Monaghan was serving a four-year jail sentence for the killing. However, he remains in prison after the court confirmed his conviction for violent disorder.

The conviction for the manslaughter of 18-year-old Brian Murphy was quashed today because of decisions taken at the trial about the editing of statements of a co-accused. The court found the conviction was unsafe and should be set aside.

However the court did not believe the circumstances were sufficient to direct an acquittal on the charge and have ordered a retrial. The court upheld Laide's conviction for violent disorder so he remains in prison to complete the two-year sentence imposed for this offence.

A second man, Desmond Ryan from Dalkey, had his conviction for violent disorder quashed by the appeal court.

He was sentenced to nine months in prison for violent disorder, but has remained on bail and today learned that his appeal has been successful.

The court found that statements taken from him, after what they ruled was an unlawful arrest should not have been admissible at the trial and they have not ordered a retrial.

The court will reconvene on 15 March when the question of the severity of Laide's two-year sentence for violent disorder is expected to be raised.

The court earlier rejected an appeal brought by Sean Mackey from Foxrock in Dublin against the severity of his sentence for violent disorder.
