The Court of Criminal Appeal has ordered a re-trial in the case of a Cork man convicted of the murder of a 22-year-old beautician.
Ian Horgan, 20, from Ballincollig, received a life sentence for strangling Rachel Kiely to death in a park four years ago.
However, today Mr Justice Adrian Hardiman accepted submissions that the trial judge had failed to outline to the jury defence claims that a DNA sample may have been contaminated.
Mr Justice Hardiman said this was unfortunate as the prosecution had a strong case but added that the DNA evidence was central.
The defendant will remain in custody until his re-trial.
