An Oireachtas Committee is to continue its investigation into Judge Brian Curtin despite claims by the judge's legal team that he is too ill to engage with the committee's work.
In a brief statement issued this afternoon, the committee said it had reached a determination on the submissions made on behalf of Judge Curtin, and that it is now proceeding with its work.
The committee was set up in June to investigate the facts behind Judge Curtin's acquittal on charges of possession of child pornography.
It is due to report back to both Houses of the Oireachtas, which will then consider whether to impeach the judge.
Judge Curtin was acquitted of the charges in May, when the case against him collapsed after it emerged that a search warrant used to collect evidence from his home in Tralee was out of date.
Since then, he has received treatment in St John of God's psychiatric hospital in Dublin, while a drink driving case against him was adjourned on health grounds.
Yesterday, the Oireachtas committee received evidence from seven doctors, either in person or in writing, on the state of the judge's health.
A legal challenge to the continuation of the committee's work is now thought likely.
