An agreement has been reached between lawyers for Judge Brian Curtin and the State that clears the way for an Oireachtas Committee to begin its inquiry into his conduct.
The High Court was due to sit today to hear a challenge by the Government to proceedings initiated by Judge Curtin.
However, it emerged this morning that he has abandoned his claim that the committee could not make an order for the production of material seized during a raid by gardaí on his home.
He had sought declarations from the court that a computer and other materials were removed unlawfully and could not be used in any process of inquiry.
Judge Curtin was acquitted of possessing child pornography last April after it was learned that a search warrant was used too late. The judge is still pursuing an action for damages against the Garda Commissioner.
The Oireachtas Committee can now make an order for the production of the material.
Today's agreement does not prevent Judge Curtin initiating further legal challenges against the inquiry in the future.
