Judge Brian Curtin has initiated legal proceedings against the State, the Attorney General and the Garda Commissioner.
A plenary summons on behalf of Judge Curtin has been lodged in the central office of the High Court in Dublin.
No further details are known.
The higher courts are on vacation at present, but special sittings are held for urgent cases.
The Taoiseach had told the Dáil the Government had received a letter from the Judge's solicitors, indicating that they had been instructed to begin proceedings.
But Mr Ahern said that up to this afternoon he had no details of whether they had in fact commenced.
He told the House that he still intends to follow the procedure for dealing with Judge Curtin as previously outlined.
Mr Ahern said that he was satisfied that on the basis of his legal advice the procedure which it was proposed to follow was constitutionally sound.
He welcomed the fact that the Judge was in a position to instruct his solicitors.
The Taoiseach went on to detail the procedures that would be followed and stressed that the removal from office of a judge was a matter for the Oireachtas and not for the Government.
