Legal battle continues over Carrickmines Castle

Campaigners opposed to the removal of a medieval ditch at Carrickmines in South Dublin have asked the Supreme Court for an early date to hear their appeal against a High Court refusal to grant them an injunction preventing the removal of the ditch.

The books of appeal are being lodged with the court today and lawyers for the appellants will appear before the Chief Justice tomorrow morning to try to secure a hearing date.

Last week Gordon Lucas and Dominic Dunne failed to get a High Court injunction preventing Dun Laoghaire/ Rathdown County Council from removing the ditch which is on the line of the South Eastern motorway.

Today the court was told that when a hearing date is set for the appeal, lawyers for Mr Lucas and Mr Dunne will write to the Council asking for an undertaking that work on the ditch will stop until the appeal has stopped.
