The High Court has heard that police radios and mobile phones may interfere with the accuracy of breath alcohol readings in suspected drink driving cases.
The claim was made before Mr Justice McKechnie who granted a Co Kildare doctor charged with a drink driving related offence an order preventing his trial from going ahead in the District Court on Monday next.
Dr Christopher Nielson of Escombe Lodge, Leixlip in Co Kildare, claimed the State had failed to provide him with reasonable facilities to inspect the intoximeter which registered his alcohol breath count as above the legal limit.
The District Court had already ruled that Dr Nielson was entitled to information on the frequencies used by garda radios and the levels at which they might interfere with the intoximeter.
The latter was not supplied to him.
Despite this, Judge Gerard Haughton had ruled that the case should go ahead next monday in the District Court.
In the High Court, Mr Justice McKechnie overturned that decision and granted an order preventing the case from going ahead until Dr Nielson had access to all the necessary information.
