Uncertainty over ownership of Dublin land

Doubt has been cast over the ownership of land in South Dublin which is the subject of a €47 million compensation claim against Dun Laoghaire Rathdown Council.

At an arbitration hearing today, it emerged that the legal team of Jackson Way Properties did not have the title documents to more than 100 acres of land in its possession.

The firm, which is being investigated by the Flood Tribunal, is making a claim against the council because a portion of its land was compulsorarily purchased for the M50 motorway.

However, at the arbitration hearing today, a letter from the company's solicitor, Stephen Miley, dated from last month, was read out in which he said "we do not have our client's title documents available at present."

The Council's legal team said there was now a degree of uncertainty over the ownership of the land.

The arbitration hearing will, however, continue as the title to the land need only be presented when a payment is being made.

Earlier this week, it emerged the Council had tried but failed to establish who the beneficial owners of the shadowy company are.

The hearing will resume on Monday.
