Court hears application by Haughey to adjourn criminal tr

The Circuit Criminal Court has begun hearing an application of behalf of Charles J. Haughey to adjourn his trial on charges of obstructing the McCracken Tribunal until the Moriarty Tribunal has concluded. However, the media's reporting of today's application has been curtailed by Court order. Counsel for Mr Haughey sought a Court order preventing publication of the contents of certain documents that are being presented to the Court to support the application being made.

They claim that the publicity generated would interfere with Mr Haughey's right to a fair trial. Eamon Leahy, SC, quoted from recent Court decisions stating that an accused's right to a fair trial is as superior right. Counsel for the DPP suggested that the Attorney General and the media should be heard before Judge Kevin Haugh made a decision. However, Judge Haugh made an order postponing publication of the details of the exhibit documents, until he has heard the substantive application.

Mr Haughey was in Court this morning, but did not return for the afternoon session. The hearing is taking place in the Green Street Courthouse, which is usually used for Special Criminal Court hearings. It is expected to last another two days.
