St Patrick's Athletic have agreed before the High Court not to terminate the contract of their chief executive Bernard O'Byrne other than by mutual consent.

On Monday, Mr O'Byrne was granted a temporary order restraining the club from removing him from his position.

His counsel, Roddy Horan, told the court today that his side had been convinced that St Pat's were about to terminate his employment. Today's undertaking replaces Monday's injunction.

Counsel for St Pat's said the club's board believed the injunction was wrongly obtained because there were ongoing negotiations with Mr O'Byrne and he indicated that St Pat's would like these negotiations to continue.

The High Court has adjourned the proceedings.

Mr Justice Thomas Smyth said that if matters are not resolved between the parties they can come back to court and litigate.

O'Byrne joined the Inchicore club as CEO in April and was given a two-year contract. That contract could only be terminated for gross misconduct or by mutual consent.

According to counsel for O'Byrne, St Pat's poor form in the league did not reflect in any adverse way on his stewardship of the club.

On November 15, two directors of the club told O'Byrne they had made a mistake in recruiting him. A week later he was offered a small amount as compensation.
