Ex-hurley maker Jack Carey charged with 14 Companies Act breaches

Jack Carey (53), a Kilkenny native and former hurley maker, appeared in court on Wednesday charged with 14 offences under the Companies Act.

At District Court 4 in Dublin's Criminal Courts of Justice, Judge John King said he was refusing jurisdiction in the case, as the case must be dealt with by a higher court.

Mr Carey, with an address in Graiguecullen, Co Carlow, has not yet lodged a plea. The case is scheduled to come back before the court in late April for service of the book of evidence.

The accused must be served with the book of evidence before the case is sent on to the Circuit Court.

Mr Carey is a brother of former Kilkenny hurling star, DJ, and former international hockey player Catriona, both of whom are also before the courts and facing unrelated charges.

Jack Carey’s charges are all alleged breaches of the Companies Act 2014.

Seven of the 14 charges facing Jack Carey relate to a company called Careysfort Assets Estates Limited, which is registered in Ireland. Mr Carey had been listed as a director of the company for ten months.

One charge alleges that, contrary to Section 876(1) of the Act, on a date prior to 14 February, 2019 that Jack Carey was "…party to the submission to the Companies Registration Office a form, namely Form B10 related to Careysfort Assets Estates Limited… containing information known to you to be information that is false in a material particular, or being reckless as to whether that information was false in a material particular or not."

B10 forms are used to notify of a change of director or secretary. A similar breach is alleged in relation to the submission of a B2 form, which relate to a change of registered office.

Three of the other charges relating to Careysfort Assets Estates Limited allege a failure to file company returns in 2021, 2022, and 2023, contrary to Section 343(11) of the Companies Act.

Three charges relate to a company called White Capital Trinity Limited where Jack Carey was listed as a director for almost three years from February 2019 to December 2021.

One charge states that, contrary to section 876(1) of the Act, Mr Carey "…on a date unknown before the 22 September, 2020 within the State, in purported compliance with the Companies Act 2014, were party to the submission to the Companies Registration Office a form, namely the Constitution related to White Capital Trinity Limited, Company Number 643883, containing information known to you to be information that is false in a material particular, or being reckless as to whether that information was false in a material particular or not…"
