RTÉ repays over €5m to correct workers' employment status

RTÉ has repaid more than €5 million to correct the employment status of workers, with more than 200 individuals reclassified as employees, the Oireachtas has heard.

Around 100 cases remain outstanding.

The Public Accounts Committee (PAC) was told that the payment of €5.2m was part of a move to classify 208 workers as staff, rather than as self-employed.

John McKeon, Secretary General of the Department of Social Protection, said "that full amount has been repaid".

"RTÉ has accepted most of our reclassifications," he revealed.

Of 708 cases which had been identified, he said, "we're most of the way there".

"We've done 609 cases so far, we've reclassified 208."

"There is 18 on appeal and there are three cases before the courts."

"We're very close to finalising that investigation," Mr McKeon told the committee.

Sinn Féin TD and Committee Chair John Brady noted that - of those completed - around a third of those who sought reclassification had secured it.

Mr McKeon said that RTÉ "have worked with us", adding that the national broadcaster views the matter as resulting from "genuine misclassification" rather than the use of "bogus" classifications.

Deputy Brady said that workers view themselves as having been "bogusly described" as having been self-employed when they were in fact staff.

Mr McKeon also said that "the vast majority" of employers accept a ruling to reclassify workers, and do so.

"Generally we find that they pay the full amount," he said, noting that there is no time limit on reclaiming PRSI which was not paid.

"There have been some cases going back to the 1990s in recent years."

In a statement, Deputy Brady later said of the RTÉ payment: "This is a very significant and growing sum, with the department still having to work through around 100 outstanding cases."

He noted that, "Government departments and state bodies were among those who availed of the recent disclosure opportunity introduced following the Karshan judgement to correct the misclassification of workers".

"Over 280 submissions were made between September 2025 and the end of January 2026, with these disclosures involving gross tax adjustments of €26.7m relating to over 6,600 employees," he said.
