A Dublin couple have asked the High Court for permission to challenge the power of the County Registrar of Dublin to make orders for the repossession of homes.

Peter and Anne Byas, who have three children, say the County Registrar acted beyond her powers in making an order for the repossession of their home last May.

The case is being taken by lawyers involved in the New Beginning group - which is offering legal representation and assistance to people who are at risk of having their home repossessed by a financial institution.

Mr Justice Michael Peart said he would give his decision on whether the couple can take the challenge tomorrow afternoon.

A six month stay on the repossession of the couple's house in Dublin expires on Saturday.
