Man charged in court with rioting and setting fire to garda car

A 30-year-old man has appeared in court charged with two offences, including setting fire to a garda car during the Dublin riots last year.

Daniel Clarke, with an address at Dolphin House in Dublin 8, is also charged with rioting at Lower O'Connell Street on 23 November, 2023.

Mr Clarke, who is the 40th person to be arrested by gardaí as part of the investigations into the public disorder, appeared before Dublin District Court this morning.

Detective Garda Sean Dineen from Store Street Garda Station gave evident of arrest, charge and caution.

He told the court the accused made no reply after he was charged and cautioned at Store Street Garda Station yesterday evening.

Det. Garda Dineen described the incidents in Dublin city centre as one of the most serious and largest scenes of public disorder in the history of the State.

He told the court the evidence against Mr Clarke was "compelling" and he said there was CCTV footage which allegedly showed the accused setting fire to a marked garda car on Lower O’Connell Street.

It was also alleged by the garda that the accused could be seen approaching the car, sticking his head inside and lighting papers.

Det. Garda Dineen said the vehicle, which had a value of €28,000, was destroyed by the blaze.

He told the court the accused was "tracked continuously on CCTV" and he was identified by gardai after later taking off a face covering that he was wearing.

Defence barrister Fergal McCarrow, who said the prosecution’s case is based entirely on CCTV, applied for bail and he also made an application for free legal aid, saying his client was in receipt of social welfare.

In response, Det. Garda Dineen said there would be no objection to bail if there was a "substantial independent surety" and other conditions attached.

Judge Marie Quirke said the charges before the court are of "the most grave and significant" and she said the allegations were of "deep concern".

She granted bail subject to an independent surety of €3,500, which she insisted is made in a cash lodgement.

Ms Justice Quirke also imposed a number of strict conditions.

She said the accused must sign on three times a week at Sundrive Road Garda Station, reside at his home address, provide a mobile phone number on which he must be contactable 24 hours a day and adhere to a curfew between 11pm and 7am.

He has been remanded accused in custody with consent to bail, to appear before Cloverhill District Court next Tuesday, 18 June.

Mr Clarke made no comment during the court appearance.

To date, dozens have people have been brought before the courts in connection with the riots in Dublin.

A total of 34 people were arrested at that time, with six others detained during subsequent inquiries.
