Three charged over Mountjoy prison violent disorder

Three men have been charged with a violent incident in Mountjoy Prison last year.

William Ward, 31, of Grantstown Mews, Grantstown Park, Waterford; Dylan Jones, 21, of Beech Drive, Greenfields, Waterford; and Scott Capper, 29, of Cappagh Green, Finglas, Co Dublin, are accused of violent disorder.

The offences allegedly took place in the prison on 27 July 2022.

They appeared before Judge Bryan Smyth at Dublin District Court after gardaí charged them this morning.

Detectives Raymond Lee, Deirdre Gill and Niall Hodgins, attached to Mountjoy Garda Station, gave evidence of arrest, charge and caution.

Mr Ward and Mr Jones made no reply to their charges, while Mr Capper's response was "no comment".

Judge Smyth heard that the Director of Public Prosecutions had directed their cases remain in the district court on guilty pleas only.

Otherwise, they will face trial on indictment in the circuit court, which has wider sentencing powers.

There was no objection to bail, and Judge Smyth adjourned their cases until 6 October, when they will be expected to indicate pleas.

The investigating officers complied with an order to disclose evidence, including CCTV, which was handed over to defence solicitor Brian Tunney.

All three defendants remained silent throughout the hearing but were granted legal aid after the judge noted they had no income or assets.

Mr Ward has to sign-on twice weekly at his local garda station and provide a contact phone, and Mr Capper has been ordered to sign-on three times a week.
